  90. Your use of MouseKeeper indicates your acceptance of the following
  91. terms and conditions:

  93. MouseKeeper ("the Software") is a Visual Basic custom control
  94. licensed by JOSWare, Inc. ("JWI").
  95.  
  96. Shareware license.
  97. You are free to distribute the entire unmodified contents of the distribution
  98. package to anyone you wish. You may NOT distribute any other programs that
  99. utilize the Software without obtaining a Registered User License for the
  100. Software from JWI. For a period of no more than 21 days, you may use, test
  101. and duplicate the enclosed version of the Software.  Thereafter if you wish
  102. to continue using the Software you must register the Software with JWI, or
  103. else you must cease all use of the Software.  You will be an infringer if
  104. you do not pay the registration fee and continue to use this version of the
  105. Software for more than 21 days.

  107. Registered User License.
  108. If you pay the registration fee for the Software to JWI, JWI will grant a
  109. non-exclusive license for one natural person to use one copy of the software
  110. regardless if the owner of the license is a person or a business
  111. ("the Licensee"). In addition the Licensee may distribute the MouseKeeper
  112. Visual Basic Custom Control ("the VBX") with any or all products that use
  113. the VBX with the exceptions that (a) the recipients of any such
  114. program ("the Recipients") are not licensed to use the VBX or the Software
  115. except with the products produced by Licensees, and (b) the Recipients may
  116. not further redistribute the VBX, and (c) the product using the VBX cannot
  117. enable the user to produce other programs using the VBX or other parts of
  118. the supplied distribution package, and (d) the product using the VBX must
  119. contain a notice stating JWI's copyright of the VBX. No purported transfer
  120. of the license shall be effective until the licensee notifies JWI of the
  121. name and address of the person receiving the license ("the Transferee"), and
  122. transfers all copies of the Software to the Transferee, and removes or
  123. destroys any other copies of the Software in the possession of, or under the
  124. control of the Licensee.

  126. Limited Warranty.
  127. The Software is distributed and licensed under an "as is" basis. For a period
  128. of 90 days from the date that you pay the registration fee, you may return
  129. all materials provided by JWI, destroy any copies you have made and then you
  130. will receive a refund of your registration fee minus a $5 restocking charge,
  131. provided that the returned materials are undamaged.  If the materials are
  132. damaged your refund will be deducted for the replacement costs of the damaged
  133. materials.

  135. Disclaimer of Warranties.
  136. JWI makes no claims as to the suitability of the software for any specific
  137. purpose. EXCEPT FOR THE LIMITED WARRANTY STATED ABOVE, JWI DISCLAIMS ANY AND
  138. ALL OTHER WARRANTIES EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING ANY
  139. WARRANTIES OF MERCHANT ABILITY OR FITNESS FOR ANY SPECIFIC PURPOSE. The
  140. Limited Warranty stated above gives you specific legal rights, but you may
  141. have other rights which may vary from state to state.

  143. Limitation of Liability.
  144. In no event shall JWI be liable for any damages whatsoever arising out of
  145. the use of the Software, including without limitation any direct, indirect
  146. or consequential damages or any damages for business interruption, loss of
  147. profits, loss of information, or any pecuniary  loss even if JWI has been
  148. notified of the possibility of such damages. The limitation or exclusion
  149. of liability for incidental or consequential damages may not be allowed in
  150. some states, and in these states those particular prohibited limitations do
  151. not apply.

  153. Limitation of Remedies.
  154. Should you have problems with the Software, JWI's entire liability and your
  155. exclusive remedy shall be, at JWI's discretion, either (a) to repair or
  156. replace the Software, or (b) to terminate the License and send you a refund
  157. of your registration fee minus a restocking charge, provided that all
  158. materials are returned undamaged. If the materials are damaged your refund
  159. will be deducted for the replacement costs of the damaged materials.

  164. The Software is protected by the copyright laws of the United States, and
  165. by the copyright laws of many other countries pursuant to international
  166. treaties. The VBX and all other materials provided in the Tree Control
  167. distribution package are Copyright (c)1994 JOSWare, Inc.  All Rights reserved.
  168. No portion of the Software, documentation or examples may be copied, stored,
  169. or transmitted except as provided by the license.
